Customers Responsibility

Lollipop Lights LLC "DOES NOT" allow pickups. Our team delivers all Full Motion Props and will complete the entire set up and installation. Once installation is set up and complete by our team, relocating our Full Motion Props is prohibited.

Rental Drop off and Pick-up times are: 6:00AM -12:00AM

Additional fees will apply for early drop offs or late pickups, fees are based on location and times.

DELIVERIES: Lollipop Lights LLC will set up a drop off time and a pickup time which will be specified on invoice. ​An additional $120 fee will be applied to your order if you need our drivers to arrive at an exact time. Our package set ups may require a specific amount of time to install and may require at least 1-2 hour for set up. If customer requires more time, there will be a fee starting at $200 for faster installation. NO ACCEPTIONS!  *Access must include vehicle parking near the venue entrance. If our drivers do not have access to venue during specified times, customer has up to 30 minutes to allow us access to the venue and setup. If we have other obligations and deliveries, we will leave immediately NO REFUNDS!

If we stay or come back at a later time, customer agrees to pay 20% of the total order, NO ACCEPTIONS! 

We will charge a $100 cleaning fee if we deem the venue has animal waste, dirt or debris. We will NOT set up our property in areas of wet soaked grass, water pockets of any kind or muddy areas. NO ACCEPTIONS!

PICK UP:  If drivers arrive at the event during the requested timeframe written in the contract or invoice, *ACCESS MUST BE NEAR THE VENUE ENTRANCE* NO ACCEPTIONS!  If drivers arrive at the event during the requested timeframe written in the contract or invoice, drivers are ready to pick up property. We will "NOT" wait any more than 30 minutes to retrieve property, this will include finding adequate parking near entrance of venue. If we are unable to pick up property within this time frame there will be a $200 fee.  In the event we are unable to pick up property due to customers culpabilities, there will be a full daily charge each day, plus an additional $300 fee.

           11-50 miles  Fee $400              

           51-60 miles  Fee $500              

61-70 miles Fee $600

When booking any Full Motion Prop, customer will provide adequate electrical power (Suitable 110v/120v) to meet the needs for any prop rentals or equipment. We will provide one free 50ft electrical cord for your order (some items, cords are not included). We offer portable batteries if venue is unable to provide enough power to generate Lollipop Lights LLC's Full Motion Props at an additional $60.00 each.

*NOTE - WE WILL NOT POWER OUR PROPS WITH ANY OTHER BATTERIES OF ANY KIND THAT ARE NOT DEEMED CERTIFIED TO OPERATE OUR PROPS FOR THE SAFETY OF OUR PRODUCTS* 

 

Lollipop Lights LLC Responsibility Lollipop Lights LLC will continue to strive and provide great customer service and be on time to each and every event. Lollipop Lights LLC will provide quality Full Motion Prop rentals in the best conditions.

STORE CREDIT, NO REFUNDS AFTER ORDER 

Customer is obligated for the first 24 hours to change orders. After the first 24 hours, changes are not allowed.

 

Customer may add items to the order, subject to the same terms. Customer acknowledges that any changes to the order after the first 24 hours are subject to store credit and will be held on file for 1 full calendar year from when the original order was placed.

Payments & Security Deposit

 20% of the rental amount is required to secure your event date. 100% of the deposit must be made 1 week prior to event. If the customer cancels the order more than 24 hours after confirmation, Lollipop Lights LLC will retain the deposit or payment. Customer is subject to store credit and will be held on file for 1 full calendar year from when the original order was placed.

NO ACCEPTIONS! 

This contract constitutes the entire Contract and the parties are not bound by any oral expression or representation by any agent of either party purporting to act for on behalf of either party or by any commitment or arrangement not specified in the Contract. Lollipop Lights LLC agrees to do all work and/or deliver the goods provided in this Contract in a good and workmanlike manner, but shall not be responsible for delay or failure to perform work and/or deliver the goods when such a delay or failure is due to, war, strikes, government prohibition, non-insurance of all required permits affecting construction, delays caused by other contractors, or reasons beyond its control. Customer will take all necessary precautions regarding any items rented and protect all persons and property from injury or damage. Customer is responsible for providing one-day insurance if the venue requires it. Customer agrees to indemnify and hold harmless Lollipop Lights LLC from and against all liability, claims, judgments, attorney fees and costs of every kind and nature, including, but not limited to, injuries or death to persons or damage to property, arising out of the use, delivery, maintenance, installation, instruction, operation, possession, ownership or rental of items rented, however caused. Customer is fully aware and acknowledged there is risk of injury or damage arising out of the use or operation of the items rented/soled hereunder and hereby elects to voluntarily enter into this rental/sale agreement and assume all of the above risks of injury or damage. Customer agrees to release and discharge Lollipop Lights LLC from any and all responsibility or liability for such injury or damage arising out of the use of the items rented/sold and customer further agrees to waive, release and discharge any and all claims for injury or damage against Lollipop Lights LLC which Customer may otherwise be entitled to assert. No additional work shall be done without the prior written authorization of Customer and Lollipop Lights LLC. Any such authorization shall be on a change order form showing the agreed terms and reasons for such changes and shall be approved and signed by both parties, and such change-order forms shall be incorporated in and become part of, this Contract. Where such additional work is added to this contract, it is agreed that the total price under this contract shall apply equally to such additional work. There are no warranties, express or implied, that the goods and materials sold, rented, or leased hereunder shall be merchantable or fit for any purpose whatsoever. No employee or agent has the authority, express or implied, to waive or modify the provisions of this paragraph in any manner whatsoever. All goods are delivered on an “as is” basis and Customer acknowledges receipt of all items listed hereunder and that such items are in good working order and repair and that Customer has been instructed in the proper operation and use thereof. When goods are shipped, titled to the goods passes to the Customer and Lollipop Lights LLC liability as to delivery ceases upon making delivery of the goods to carrier at the F.O.B. shipping point in good condition. Customer acknowledges that goods and materials delivered were inspected at the time of delivery/will call. If Customer is not present at time of delivery/pick up, Customer accepts Lollipop Lights LLC's count and accepts responsibility for any lost or damaged equipment. Customer shall be responsible for all damage to rented items not caused by ordinary wear and tear. Damage or loss will be assessed as soon as possible after the conclusion of the event. All visible damage will be photographed on-site whenever possible. A cleaning charge may be imposed for items returned unclean. Customer is fully responsible for Any Damages made to equipment including; Vandalism, Mother Nature, Negligence All Items and Services are Optional Excluding Sales Tax unless proof of Exemption Can be provided. Unless otherwise specified in writing, payment is due in full One Week Prior to delivery, unless otherwise specified. If the contract calls for progress payments and Customer fails to make any progressive payment required under the contract on time, Lollipop Lights LLC shall have the option to rescind the contract or declare breach of contract. In the event of recession or declaration of breach of contract, Customer shall promptly pay Lollipop Lights LLC the reasonable value of work completed on the project as measured by the Contract price, plus all Lollipop Lights LLC damages including loss of profit. Until all payments hereunder are fully paid, title and right of possession to all materials, parts, etc. used by Lollipop Lights LLC shall remain with Lollipop Lights LLC. In the event of subsequent Customer default, the outstanding value of the trade balance shall be paid in cash. Additionally, Customer shall be responsible for any and all reasonable fees, including reasonable attorney’s fees, incurred by Lollipop Lights LLC to enforce the terms and conditions of this contract. In case of any dispute arising under this Contract, all costs, including filing fees and reasonable attorney’s fees will be paid to the party prevailing in litigation. Customer agrees to pay all costs and reasonable attorney’s fees incurred in the collection of all past due invoices and accounts. Customer is responsible for any necessary permits that may be required unless otherwise arranged with Lollipop Lights LLC in writing. Customer is responsible for notifying Lollipop Lights LLC in writing of any main lines prior to staking. Customer expressly agrees that Lollipop Lights LLC is not responsible for any underground damages due to driving stakes into the ground. Purchases / Installation of Customer’s Equipment Lollipop Lights LLC is NOT Liable for any Damages or Injuries that may occur during weather related events or neglect or Vandalism , It is the Customers responsibility to properly maintain and inspect equipment.
